Refusal Or Discontinuance Of Service :

Aalpha NET reserves the right to refuse or discontinue service to anyone at aalpha NET's sole discretion. Aalpha NET may deny you access to all or part of the service without notice if you engage in any conduct or activities that Aalpha NET in its sole discretion believes violates any of the terms and conditions in this agreement. Aalpha NET shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification. You agree that Aalpha NET has the right to monitor the service electronically from time to time and to disclose any information as necessary to satisfy the law, or to protect itself or its subscribers. Aalpha NET reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement.

Illegal Content

Our Hosting services may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes a legal threat, or violates export control laws. Examples of unacceptable content or links: "Pirated software", "Hackers programs or archives", "Warez Sites", "Irc Bots", "Mp3".

We will be the sole arbiters as to what constitutes a violation of this provision.

Spamming

Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is expressly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site or distributing, advertising or promoting software or services that have the primary purpose of encouraging or facilitating unsolicited commercial E-mail or spam.

It is contrary to aalpha NET's policy for customers to use our servers to effect or participate in any of the following activities:

To post to any Usenet or other newsgroup, forum, e-mail mailing list or other similar group or list articles which are off-topic according to the charter or other owner-published FAQ or description of the group or list;

To send unsolicited mass e-mailings, if such unsolicited e-mailings provoke complaints from the recipients;

To engage in any of the foregoing activities using the service of another provider, but channeling such activities through a aalpha NET provided server, or using a aalpha NET provided server as a maildrop for responses;

To falsify user information provided to aalpha NET or to other users of the service in connection with use of a aalpha NET service.

When aalpha NET becomes aware of an alleged violation of its Acceptable Use Policy, aalpha NET will initiate an investigation (within 24-48 hours). During the investigation aalpha NET may restrict Customer 's access in order to prevent further possible unauthorized activity. If the Customer is found in violation of our SPAM policy, aalpha NET may, at its sole discretion, restrict, suspend, or terminate Customer's account and/or pursue other civil remedies. Also, aalpha NET reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. If such violation is a criminal offense, aalpha NET will notify the appropriate law enforcement department of such violation.

The Customer shall be held liable for any and all costs incurred by aalpha NET as a result of the customer's violation of these terms and conditions. This is including, but is not limited to, attorney fees and costs resulting from Postmaster responses to complaints from and the cleanup of unsolicited commercial mailings and/or unauthorized bulk mailings and/or news server violations.

Age :

The Customer certifies that he or she is at least 18 years of age.

Privacy:

AALPHA NET will make every effort to protect the privacy of AALPHA NET's clients. AALPHA NET will not reveal personal information regarding its clients. AALPHA NET cannot however protect privacy through the Internic registration database as this information is open to the public

Limitation of Liability :

Aalpha NET shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Aalpha NET reserves the right to terminate an account at any time and for any reason that causes harm to any Aalpha NET customer's web sites. Aalpha NET reserves the right to delete all content and files upon termination. Aalpha NET reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. Aalpha NET reserves the right to refuse, cancel, or suspend service at our sole discretion. Aalpha NET reserves the right to change the Acceptable Use Policy without prior notice or warning. Non-enforcement of any part of the Acceptable Use Policy does not constitute consent.

Client expressly agrees that use of AALPHA NET's Server is at Client's sole risk. Neither AALPHA NET, its employees, affiliates, agents, third party information providers, merchants licensers or the like, warrant that AALPHA NET's Server service will not be interrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the Server service or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through the AALPHA NET Server service, unless otherwise expressly stated in this Agreement.

Security :

You agree that the security of your account is solely your own responsibility.

Backup Of Data :

No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content any information. If loss of data occurs due to an error of Aalpha NET, Aalpha NET will attempt to recover the data for no charge to the client but does not guarantee its recovery. If data loss occurs due to negligence of client in securing their account or by an action of the client, Aalpha NET will attempt to recover the data from the most recent archive for a Rs.5000/- fee

Abuse of the legal rights of others :

Examples of unacceptable activities in this regard include posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code which will have a deleterious effect on third party computers. Aalpha NET supports free speech on the Internet, and will not suspend or cancel a customer's account simply because it disagrees with the views expressed by the customer. Where there are allegations that a customer's on-line activity has violated the legal rights of a third party, Aalpha NET will not substitute itself for a court of law in deciding tort claims raised by the third party.

Contract Revisions:

Revisions to this Contract will be applicable to previous Contracts. Revisions will be considered agreed to by the Client on renewal of aalpha NET's Services.

Value Added Reselling:

Clients approved and authorized as aalpha NET resellers are allowed to resell the storage and transfer services provided by AALPHA NET as provided for in its standard product offering. Client agrees to handle and is responsible for all third-party client's content, support, set-up, maintenance and billing. Client agrees to having the necessary additional knowledge and skill level required. Client also agrees that they are responsible for all payments for accounts brought on by client under the reseller program.

payments & Taxes :

All payments made to aalphanet are non-refundable. AALPHA NET shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made from Client or AALPHA NET's server. Client agrees to take full responsibility for all taxes and fees of any nature associated with such products sold.

Jurisdiction in Case of Disputes
In case of any disputes, the jurisdiction will be ONLY at MADURAI Courts. Aalpha NET reserves the right to change the Acceptable Use Policy without prior notice or warning. Non-enforcement of any part of the Acceptable Use Policy does not constitute consent.
Violations of these Acceptable Uses Policies should be referred to abuse@aalphanet.com

Modification

aalpha NET reserves the right to add, delete, or modify any provision of this Policy at any time without notice.
